Yoreh De'ah · Nedarim

Siman 209 — Answering “amen” to another man’s vow

A single seif, and two mechanisms that are easily confused. The first: a man has vowed nothing — his fellow vowed about him — and he merely answered אמן. The Shulchan Arukh holds him bound on the same footing as one who vows, because his answer is an acceptance of the words; hence the extension to any formula of the same force, in any language. The second: when what is forbidden belongs to the speaker, no acceptance is required — and that clause, the shortest in the siman, is read in three different ways by the Beit Yosef, the Taz and the Nekudot HaKesef. (Shulchan Arukh, Yoreh De’ah 209 — one seif)

Both one who vows of his own accord and one whose fellow imposed a vow upon him and who said “amen” are alike… but when his fellow imposes a vow upon him out of what belongs to that fellow, he need not accept his words. The seif first states that the two men are equal, gives the reason — it is an acceptance of the words — and then turns the case around.

Base — Beginner & Intermediate

The seif in Hebrew, with a flowing English rendering and a clause-by-clause breakdown: the heading, the equality of the man who vows and the man who answers amen, the reason (קבלת דברים), the extension to any equivalent formula, and the clause about forbidding one’s own property. All six entries of the apparatus — Shach, Taz, Ba’er Hetev, Pitchei Teshuva, Nekudot HaKesef — quoted one by one.

Frequently asked questions — Siman 209

Does answering “amen” to another man’s vow really bind?

Yes, and on the same footing as if one had vowed oneself. The seif sets the two men side by side:

The gemara derives the rule from the verse of the suspected wife, whose answer places her under the kohen’s oath. For your own situation, ask your Rav.

Must one have said precisely the word “amen”?

No. The seif writes so itself, and gives the reason: what operates is the acceptance.

Rambam adds בכל לשון — in any language. For your own situation, ask your Rav.

And the man who only says “I too”?

He is a מתפיס, and Rambam exempts him — but at once notes that the prohibition remains:

Exempt from lashes and sacrifice does not mean permitted. For your own situation, ask your Rav.

May one forbid one’s property to a man who refuses?

That is precisely the point the Acharonim argue over, and it stays open.

Beit Yosef, Shach and Nekudot HaKesef say yes; the Taz reads the clause otherwise. An open disagreement: ask your Rav.

Does that power have a limit?

Yes, and it is a limit of acquisition law: the thing must still be his.

Too late, the word does not carry. In time, it binds — and payment does not erase the prohibition. For your own situation, ask your Rav.
