Yoreh De'ah · Nedarim

Siman 210 — Mouth and heart (שצריך לפרוט הנדר כשפתיו)

Three seifim, and one question beneath all three: what does it take for a word to bind? The Shulchan Arukh answers with two conditions and not one — he must have spoken, and what he said must be what he meant. Hence the first seif, which examines the two ways speech can part from thought: the other word, which binds nothing, and the wider word, which binds on what they share. Hence the second, which takes the limiting case of a vow pronounced in a dream. And hence the third, which requires the retraction itself to pass through the mouth. (Shulchan Arukh, Yoreh De’ah 210 — 3 seifim)

The vow does not take hold until he has articulated it with his lips and his mouth and his heart are alike. The seif opens with the twofold condition, and the whole siman is nothing but the examination of cases where the two do not coincide.

LEVEL 01

רמת המתחיל

Base — Beginner & Intermediate

The three seifim in Hebrew, with a flowing English rendering and a clause-by-clause breakdown: the twofold requirement, barley bread and plain bread, the mind of others, the vow in a dream and its two positions, immediate retraction and its condition. All twenty-one entries of the apparatus — Shach, Taz, Ba’er Hetev, Pitchei Teshuva, Nekudot HaKesef — quoted one by one.

רמת הלמדן

Lamdan — Talmid Hakham

Analysis in depth: the two verses in Shevuot; the ḥakira on what thought does; the Ba’h and the Shach against the Beit Yosef on a wide word said deliberately, and the Chavot Yair’s doubt; the Rosh’s difficulty about the extortioner and the answers of the Ramban and the Tosafot; the Rosh against the Rashba on dreams, and the divergence of Taz and Ba’h about a woman; the Raavad’s objection and the Rama’s resolution.

Frequently asked questions — Siman 210

Does a resolve taken within oneself bind?

No. The seif lays down the requirement of speech before anything else:

The Taz brings the rule back to its verse in three words. For your own situation, ask your Rav.

And if the word spoken is not the one he had in mind?

Nothing takes hold, on either, and the Shach says why:

The wheat because the mouth did not say it, the barley because the heart did not mean it. For your own situation, ask your Rav.

And if the word spoken is wider than the thought?

The vow holds on what the two share — but the Acharonim differ where the wide word was chosen deliberately:

The Ba’h, the Shach and the Maharshal then forbid all bread; the Chavot Yair would incline to permit the barley without daring to rule. An open disagreement: ask your Rav.

Does a vow pronounced in a dream count?

By the letter of the seif, no — and there is not even a release to be made. But the Mehaber requires the other view to be reckoned with:

The Shach writes that such is the practice; the Rama allows three men where ten are lacking; and the Taz found a responsum of the Maharal of Prague ruling like the first view. For your own situation, ask your Rav.

How long does one have to retract?

The time of a greeting, and it is counted from the vow:

And the retraction must be spoken: having thought it is worth nothing. This is the Rama’s gloss, which the Taz and the Shach uphold against the Beit Yosef. For your own situation, ask your Rav.
