Yoreh De'ah · Nedarim

Siman 211 — The condition made in advance

Four seifim on one situation: a man declares that what he is about to vow shall not be a vow, and then vows. The Shulchan Arukh answers in two stages. Said in the same breath, the disavowal prevails — provided it left the lips, since an inward reservation undoes nothing. Laid down long before, it works only in forgetfulness: a man who vows while remembering that he protected himself withdraws his protection. Seif 3 deals with incomplete remembrance and the formula that saves it, and seif 4 sets the limit: none of this reaches what another man made him swear. It is here that the Rama’s gloss attaches כל נדרי, in two lines of which the second narrows the first. (Shulchan Arukh, Yoreh De’ah 211 — 4 seifim)

One who says: the vow I wish to vow shall not be a vow — and he vowed — it is not a vow. The seif opens with the simplest case, and the whole siman consists in saying what weakens it: thought instead of speech, distance in time, and a vow another man imposes.

LEVEL 01

Base — Beginner & Intermediate

The four seifim in Hebrew, with a flowing English rendering and a clause-by-clause breakdown: the simultaneous disavowal and its formal condition, the view on בלחש, the Rama’s gloss on כל נדרי, the old condition and remembrance, the formula על דעת ראשונה, and the limit of seif 4. All eighteen entries of the apparatus — Shach, Taz, Ba’er Hetev, Pitchei Teshuva, Nekudot HaKesef — quoted one by one.

Analysis in depth: the mishnah of Rabbi Eliezer ben Yaakov and the two readings of Abaye and Rava; the Ran’s answer on the difference between seifim 1 and 2, and the Prisha’s criterion which the Taz rejects and the Nekudot HaKesef defend; the dispute over בלחש and the Levushei Serad’s ruling; what the gloss on כל נדרי establishes and what it reserves; the Taz’s study of the interval, and its refutation.

Frequently asked questions — Siman 211

May one annul one’s future vows in advance?

Yes, and the seif says so without reservation — but on one formal condition:

The disavowal must leave the lips. Merely thought, it undoes nothing. For your own situation, ask your Rav.

And a condition laid down long ago?

It operates only in forgetfulness, and the seif gives the reason:

To vow while remembering one’s condition is to withdraw it. And the יש אומרים adds that one must recall it at once and rely on it. For your own situation, ask your Rav.

What must one say if one has forgotten what the condition covered?

That is seif 3, and it gives the exact formula:

The Taz makes clear that in this case the man does remember making a condition: it is only its object he does not know. For your own situation, ask your Rav.

What does the Shulchan Arukh say about כל נדרי?

Two things, and they must be held together:

The declaration counts as an express stipulation; but we do not rest on it to permit without a request to a sage, save for a great need. The Shach adds that the gloss belongs to seif 2, and that for an oath taken while holding an object it is not established that it avails. For your own situation, ask your Rav.

Does this apply to an undertaking made to somebody else?

No, and seif 4 says so without qualification:

The reason, given by the Beit Yosef in the name of the Ran and the Tosafot: it is on the other man’s intention that he swears. For your own situation, ask your Rav.
