Level 4 — Daat HaRav (Alter Rebbe) — Siman ק״ו · מִי הֵם הַפְּטוּרִים מִתְּפִלָּה

The Alter Rebbe’s way on מִי הֵם הַפְּטוּרִים מִתְּפִלָּה : whoever is exempt from ק״ש is exempt from תְּפִלָּה, except the מְלַוֵּי הַמֵּת ; נָשִׁים וַעֲבָדִים — obligated in תְּפִלָּה ; חִנּוּךְ הַקְּטַנִּים ; and מִי שֶׁתּוֹרָתוֹ אֻמָּנוּתוֹ — the הַפְסָקָה for ק״ש and תְּפִלָּה — in the Habad sensibility.

Why a Level 4 devoted to the Alter Rebbe ? The Alter Rebbe’s Shulchan Aruch is not a commentary on the Mehaber (מחבר) — it is a complete, self-standing Shulchan Aruch, written by the Alter Rebbe (Rabbi Schneur Zalman of Liadi, founder of Habad, disciple of the Maggid (מגיד) of Mezeritch). Its singularity : it combines halakha (הלכה) + טעמי המצוות + inner dimension in one work, and rules with a unique Talmudic rigor.

For Habad, the Alter Rebbe is הפוסק האחרון — his psak is the deciding authority. This page gathers the Rav’s way on siman ק״ו — מִי הֵם הַפְּטוּרִים מִתְּפִלָּה. In the Rav it unfolds over ד׳ סְעִיפִים (four seifim) : the parity between חִיּוּב ק״ש and חִיּוּב תְּפִלָּה with the exception of the מְלַוֵּי הַמֵּת, the obligation of נָשִׁים וַעֲבָדִים and its basis, the חִנּוּךְ הַקְּטַנִּים, and the מִי שֶׁתּוֹרָתוֹ אֻמָּנוּתוֹ (חַיֵּי עוֹלָם וְחַיֵּי שָׁעָה).

סעיף א כָּל הַפְּטוּרִים מִק״ש — פְּטוּרִים מִתְּפִלָּה ; חוּץ מִמְּלַוֵּי הַמֵּת.

The exempt and the obligated. Whoever is exempt from ק״ש is exempt from תְּפִלָּה ; whoever is obligated in ק״ש is obligated in תְּפִלָּה — except the מְלַוֵּי הַמֵּת (those escorting the dead) whose מִטָּה does not need them : although obligated in ק״ש, they are exempt from תְּפִלָּה, since it is מִדִּבְרֵי סוֹפְרִים and said standing (בַּעֲמִידָה) without being able to linger so long, whereas the essence of the kavana and standing of ק״ש is only the first verse, easily said standing with kavana.

סעיף ב נָשִׁים וַעֲבָדִים — חַיָּבִים בִּתְפִלָּה ; וְכֵן עִקָּר שַׁחֲרִית וּמִנְחָה.

Women and slaves. Though exempt from ק״ש, they are obligated in תְּפִלָּה, for it is a מִצְוַת עֲשֵׂה שֶׁלֹּא הַזְּמַן גְּרָמָא : its essence is מִן הַתּוֹרָה (« וּלְעָבְדוֹ בְּכָל לְבַבְכֶם » — what is the עֲבוֹדָה of the heart ? that is תְּפִלָּה), with no fixed נֻסָּח, once a day sufficing מִן הַתּוֹרָה. On this reasoning, most women do not pray the י״ח regularly. But יֵשׁ אוֹמְרִים that the essence is מִדִּבְרֵי סוֹפְרִים (Anshei Knesset HaGedola who instituted the י״ח בְּרָכוֹת — שַׁחֲרִית and מִנְחָה חוֹבָה, עַרְבִית רְשׁוּת) : though it is zman gerama, they obligated them in שַׁחֲרִית and מִנְחָה, since תְּפִלָּה is בַּקָּשַׁת רַחֲמִים — וְכֵן עִקָּר. But עַרְבִית (רְשׁוּת), women did not accept.

סעיף ג קְטַנִּים שֶׁהִגִּיעוּ לְחִנּוּךְ — לְחַנְּכָם לְהִתְפַּלֵּל עֶרֶב וָבֹקֶר.

קְטַנִּים שֶׁהִגִּיעוּ לְחִנּוּךְ — חַיָּבִים לְחַנְּכָם לְהִתְפַּלֵּל י״ח עֶרֶב וָבֹקֶר. וּמִכָּל מָקוֹם, רַשַּׁאי לִתֵּן לָהֶם לֶאֱכֹל קֹדֶם תְּפִלַּת שַׁחֲרִית וְאָסוּר לְעַנּוֹתָם, כְּמוֹ שֶׁיִּתְבָּאֵר בְּסִימָן רס״ט וְשמ״ג לְעִנְיַן לְהַאֲכִילָם קֹדֶם קִדּוּשׁ:

Educating the children. Children who have reached the age of חִנּוּךְ — one is obligated to train them to pray the י״ח evening and morning. Nevertheless, it is permitted to give them to eat before תְּפִלַּת שַׁחֲרִית and it is forbidden to afflict them (לְעַנּוֹתָם), as will be explained in סימן רס״ט and שמ״ג regarding feeding them before the קִדּוּשׁ.

סעיף ד מִי שֶׁתּוֹרָתוֹ אֻמָּנוּתוֹ — מַפְסִיק לק״ש וְלֹא לִתְפִלָּה ; אֲבָל אָנוּ מַפְסִיקִין.

One whose Torah is his craft. One whose Torah is his craft (like רשב״י and his companions) — interrupts for ק״ש and blesses before and after, but does not pray at all : since he never interrupts his study, he does not interrupt it for תְּפִלָּה either. For though one interrupts for every mitsva, תְּפִלָּה being only בַּקָּשַׁת רַחֲמִים over the affairs of this world — he does not leave aside the חַיֵּי עוֹלָם (the eternal) for the חַיֵּי שָׁעָה (the fleeting). But we interrupt both for ק״ש and for תְּפִלָּה, since without this we neglect much. If he teaches others and the study would be lost — he does not interrupt, even if the זְמַן passes. Nevertheless he stops to read the first verse of ק״ש (קַבָּלַת מַלְכוּת שָׁמַיִם) and a הֲלָכָה mentioning יְצִיאַת מִצְרַיִם. And if there is time for ק״ש and תְּפִלָּה — he does not interrupt at all (cf. סימן פ״ט).

היסוד — מִי הֵם הַפְּטוּרִים מִתְּפִלָּה

The yesod : who is exempt from prayer

The Alter Rebbe’s reading of this siman unfolds along four axes. First the parity between חִיּוּב ק״ש and חִיּוּב תְּפִלָּה, with the exception of the מְלַוֵּי הַמֵּת. Then the obligation of נָשִׁים וַעֲבָדִים and its basis. Then the חִנּוּךְ הַקְּטַנִּים. Finally the מִי שֶׁתּוֹרָתוֹ אֻמָּנוּתוֹ and the חַיֵּי עוֹלָם וְחַיֵּי שָׁעָה.

הַפְּטוּרִים וְהַחַיָּבִים — חוּץ מִמְּלַוֵּי הַמֵּת

Exempt and obligated — except the melavei hamet

The principle. כָּל הַפָּטוּר מִק״ש פָּטוּר מִתְּפִלָּה ; וְכָל שֶׁחַיָּב בִּק״ש חַיָּב בִּתְפִלָּה — except the מְלַוֵּי הַמֵּת (whose מִטָּה does not need them) (seif א).

The consequence. The Rav’s טַעַם : תְּפִלָּה is מִדִּבְרֵי סוֹפְרִים and בַּעֲמִידָה, whereas ק״ש עִקָּרוֹ is the first verse — easy while standing. Cf. siman 105.

נָשִׁים וַעֲבָדִים — חַיָּבִים בִּתְפִלָּה

Women and slaves — obligated in prayer

The principle. נָשִׁים וַעֲבָדִים — obligated in תְּפִלָּה, a מ״ע שֶׁלֹּא הַזְּמַן גְּרָמָא ; מַחֲלֹקֶת whether its essence is מִן הַתּוֹרָה or מִדִּבְרֵי סוֹפְרִים (seif ב).

The consequence. וְכֵן עִקָּר : they are obligated in שַׁחֲרִית and מִנְחָה, since תְּפִלָּה is בַּקָּשַׁת רַחֲמִים ; עַרְבִית (רְשׁוּת) — not accepted. Cf. siman 107.

חִנּוּךְ הַקְּטַנִּים

The education of children

The principle. קְטַנִּים שֶׁהִגִּיעוּ לְחִנּוּךְ — to train them to pray the י״ח עֶרֶב וָבֹקֶר (seif ג).

The consequence. רַשַּׁאי לְהַאֲכִילָם קֹדֶם שַׁחֲרִית וְאָסוּר לְעַנּוֹתָם (cf. סימן רס״ט and שמ״ג). Cf. siman 107.

מִי שֶׁתּוֹרָתוֹ אֻמָּנוּתוֹ — חַיֵּי עוֹלָם

One whose Torah is his craft

The principle. כְּגוֹן רשב״י וַחֲבֵרָיו — interrupts for ק״ש and not for תְּפִלָּה ; but we interrupt for both (seif ד).

The consequence. אֵין לוֹ לְהָנִיחַ חַיֵּי עוֹלָם וְלַעֲסֹק בְּחַיֵּי שָׁעָה ; nevertheless he reads the first verse of ק״ש. Cf. siman 89.

A note for study. The scope of this siman — the ק״ש/תְּפִלָּה parity, the obligation of נָשִׁים, the חִנּוּךְ and the תּוֹרָתוֹ אֻמָּנוּתוֹ — bears on the daily conduct of תְּפִלָּה. The lines of force of the Rav’s way on this siman

Three orientations that mark the Alter Rebbe’s sensibility on this siman. Each follows the structure : principle of the siman → the Rav’s reading → practical consequence. Each line rests on the Rav’s real text (§1).

קו א — תְּפִלָּה כְּבַקָּשַׁת רַחֲמִים

Line 1 — prayer as בקשת רחמים

Principle of the siman : the same טַעַם runs through the siman — תְּפִלָּה is בַּקָּשַׁת רַחֲמִים (seifim א-ב-ד).

The Rav’s reading : this טַעַם exempts the מְלַוֵּי הַמֵּת, obligates the נָשִׁים in שַׁחֲרִית and מִנְחָה, and excludes the תּוֹרָתוֹ אֻמָּנוּתוֹ. Cf. siman 105.

Practical consequence : תְּפִלָּה is understood as a supplication, not a mere recitation.

קו ב — עִיקַּר מִצְוַת תְּפִלָּה

Line 2 — the essence of the mitsva of prayer

Principle of the siman : מַחֲלֹקֶת whether its essence is מִן הַתּוֹרָה (״וּלְעָבְדוֹ בְּכָל לְבַבְכֶם״) or מִדִּבְרֵי סוֹפְרִים (seif ב).

The Rav’s reading : the Rav brings both views and rules — וְכֵן עִקָּר — that the נָשִׁים are obligated in שַׁחֲרִית and מִנְחָה. Cf. siman 107.

Practical consequence : women pray שַׁחֲרִית and מִנְחָה ; עַרְבִית (רְשׁוּת) per custom.

קו ג — חַיֵּי עוֹלָם וְחַיֵּי שָׁעָה

Line 3 — eternal life and fleeting life

Principle of the siman : מִי שֶׁתּוֹרָתוֹ אֻמָּנוּתוֹ does not pray כָּל עִיקָּר ; but we interrupt (seif ד).

The Rav’s reading : אֵין לוֹ לְהָנִיחַ חַיֵּי עוֹלָם (study) וְלַעֲסֹק בְּחַיֵּי שָׁעָה ; but we, who neglect much, do interrupt. Cf. siman 89.

Practical consequence : in practice one interrupts for ק״ש and תְּפִלָּה ; a true תּוֹרָתוֹ אֻמָּנוּתוֹ is exceedingly rare today.

הלכה למעשה — מנהג חב״ד

Habad practice

Points of conduct that follow directly from siman ק״ו in the sensibility of the Alter Rebbe and Habad — presented at the level of the principle, deferring to the Rav for the detail of cases.

For the Habad Hassid — Siman ק״ו (מִי הֵם הַפְּטוּרִים מִתְּפִלָּה)

  • ① The exempt and the obligated. Whoever is exempt from ק״ש is exempt from תְּפִלָּה, and vice versa — except the מְלַוֵּי הַמֵּת, exempt from תְּפִלָּה (מִדִּבְרֵי סוֹפְרִים, בַּעֲמִידָה). Basis : SA HaRav ק״ו seif א.
  • ② נָשִׁים. Women are obligated in שַׁחֲרִית and מִנְחָה (בַּקָּשַׁת רַחֲמִים, וְכֵן עִקָּר) ; עַרְבִית (רְשׁוּת) — most did not accept. Basis : SA HaRav ק״ו seif ב.
  • ③ חִנּוּךְ. Train the קְטַנִּים who reached the חִנּוּךְ to pray the י״ח עֶרֶב וָבֹקֶר. Basis : SA HaRav ק״ו seif ג.
  • ④ לְעַנּוֹתָם. It is permitted to feed the children before שַׁחֲרִית and forbidden to afflict them (cf. סימן רס״ט and שמ״ג). Basis : SA HaRav ק״ו seif ג.
  • ⑤ תּוֹרָתוֹ אֻמָּנוּתוֹ. In practice we interrupt for ק״ש and תְּפִלָּה (unlike רשב״י) ; a תּוֹרָתוֹ אֻמָּנוּתוֹ reads at least the first verse of ק״ש. Basis : SA HaRav ק״ו seif ד.
